Welcome to the Almond Tree Foundation (ATF), a Community Interest Company (CIC) registered in the UK whose aim is to provide wellbeing education. The term ‘Almond Tree Foundation’ or ATF or ‘us’ or ‘we’ refers to the owner of this website whose registered office is 41 Canons Drive, Edgware, Middx, HA8 7RB, UK. The term ‘You’ or ‘Your’ refers to any user or viewer of our website.

Our terms and conditions cover the use of this website (site) - thealmondtree.org. Please take the time to read and understand these terms and conditions (terms). They govern your use of the website and any services we offer (e.g. webinar recordings, live sessions etc.). In these terms and conditions, content means all the content available on the site including but not limited to streamable videos and audio files.

By using our website or joining our mailing list, you agree to the terms as a legally binding agreement between you and the ATF. If you disagree with any part of these terms and conditions, please do not use our website. The use of this website is subject to the following terms of use:

1. Availability and Use of the site

The site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the site or the provision of the site’s services and content, for maintenance, technical or other reasons.

When accessing and using the site and its services and content, you must comply with directions, instructions or protocols posted on the site. We are pleased to be able to offer a wide range of exclusive content on the site for your educational and learning needs, which we aim to regularly add to. The content will be updated, changed or removed from time to time, at our discretion, so we can’t guarantee that specific content will always be available on the site.

You will keep any login information such as user id and/or passwords confidential and recognise that we shall not be liable should you suffer any loss on account of there being any unauthorized use of these details due to you not keeping this information safe.

You agree to indemnify us against any claims, liabilities, damages, losses, costs and expenses (including legal fees) that we may incur as a result of you not abiding by these terms & conditions.

2. Rights to content; Intellectual property

Each item of content is the copyright of its author. We own all ATF-attributed content, and all other rights in the site including its design, compilation and look and feel. Your use of the site gives you a right (a revocable, non-exclusive licence) to use the content for personal purposes. You must not redistribute content. If you love the content, please refer your friends too! You may freely use the concepts contained within the content (that is, the knowledge you gain) for any personal purpose. The trademarks and logos displayed on the site are, unless otherwise stated, those of the ATF and others, and you must not use these without the approval of the relevant owner.

We cannot guarantee that our content is free from any possible corruption including but not limited to viruses. Although we will use our best endeavours to ensure any content supplied is free from any such corruption, we disclaim any liability for the consequences of you accessing such content and you do so at your own risk.

3. Fair use and prohibited conduct

Your use of the site is subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that your use of the site and the content must be fair, genuine and reasonable. We will use our reasonable discretion to decide whether a user has complied with the ‘fair use’ policy. You must not use scripts to automatically mass download content.

You also must not:

  1. use a false email address, impersonate others, or misrepresent your affiliation with others;

  2. insert advertising, branding or other promotional content into the site or content;

  3. attempt to gain unauthorised access to computer systems or materials through the site;

  4. engage in the automatic gathering of information from or through the site (such as ‘spidering’, ‘screen scraping’, ‘database scraping’ or ‘harvesting of email addresses’);

  5. attempt to interrupt or alter the site’s operation in any way (for example through sending mass unsolicited messages, ‘flooding’ servers, or introducing a virus, time bombs, trojan horse, worm, cancelbot or other computer routines);

  6. use the site or the content in a way that violates applicable law, that violates third-party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory; or

  7. except as allowed in these terms, copy, distribute, transmit, modify or otherwise exploit the content or any other data or code made available through the site.

4. Intellectual property complaints

We respect the intellectual property rights of others and require that you do the same. Please contact us if you believe that your intellectual property or other rights are being affected by anything on the site. If you are specifically making a copyright-based claim regarding content, please forward the following information to us:

  1. your address, telephone number, and email address;

  2. a description of the location of the alleged infringing material;

  3. a description of the copyrighted work that has been allegedly infringed; and

  4. a statement by you that you warrant that the information given in your claim is accurate and that you are either the copyright owner or are authorised to act on the copyright owner’s behalf.

5. Booking terms and conditions

Using our website to donate, book or sign up for a service, programme or product (whether free or paid) indicates acceptance of these booking terms and conditions.

By booking through our website online system, you are registering yourself, or others within your organisation for the ATF services.

When your tickets have been booked, an invoice will not be automatically emailed to you. Please ask if you require a copy.  Any payment is typically taken at the time of purchase, but in any event, payment must be made within 14 days of the purchase date.

Cancellations must be made via email to our office and are given at our discretion. 

It may be necessary for reasons beyond the control of the organisers to alter the content, speakers or timings of the events.

In the unlikely event that the ATF has to cancel the event, your ticket cost will be reimbursed. the ATF is not able to reimburse you for any other costs like travel or accommodation.

6. Privacy

Our information collection and use of any personal information about you are set out in our Privacy Policy. Personal information that you disclose may be used by the ATF, its agents and contractors in relation to your use of the site, including marketing activities for the site. We may disclose any personal information as necessary to satisfy any law, regulation or government request. Our website uses cookies to monitor browsing preferences. 7. Liability and disclaimer

Except as provided in an applicable Non-excludable Law, we are bound only by the express promises made in these terms and are not bound by implied terms.

Except as provided in an applicable Non-excludable Law:

  1. The ATF content is purely educational in nature. We (the ATF) are not medical professionals in any capacity. Therefore nothing we provide can be considered a medical recommendation/diagnosis either explicitly or through implication.

  2. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

  3. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

  4. We do not promise that the content or your access to the site will be uninterrupted or error-free, that any defects will be corrected, or that the site or content is free of viruses or any other harmful components; and

  5. We make no promises regarding your access to, or the results of your access to the site or content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise.

  6. The site may make reference to or include links to external websites. We are in no way liable for the accuracy or authenticity of the information these sites may include. Should you choose to access these sites you shall do so at your own risk.

 

Except as provided in an applicable Non-excludable Law, we and our affiliates are not liable for indirect, incidental, special or consequential damages, loss of revenue or loss of profits which result from any use of or access to, or any inability to use or access the site.

8. Changes to terms

We may change these terms from time to time, but you are responsible for regularly checking these terms & conditions and keeping up to date with any changes. You will be given the opportunity to cancel any subscription with a pro-rata refund (based on the time remaining in your subscription) if you do not want to accept the changes. If you do not opt out in this way, your continued subscription to and use of the site will be an acceptance of the updated terms.

9. Applicable Laws

We control and operate the site from our offices in the United Kingdom. These Terms and Conditions and your use of ATF services shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these Terms and Conditions or through the use of ATF services shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing contained herein shall affect your consumer rights under English law.
